General Terms and Conditions

These General Terms and Conditions regulate the relationship between you and Sakani Technology Solutions FZ-LLC, a limited liability company incorporated under the laws of the Dubai Development Authority and registered under license no. 101339 and having its place of business at HD39B, First Floor, In5 Tech, Dubai Internet City, and cover your use and access to the Platform and/or the Platform Services.

Capitalised terms used in these General Terms and Conditions have the meanings given to them in the definitions section at clause 1 below.

By accessing and using the Platform, you acknowledge that you have read, understood, and agreed to be bound by these General Terms and Conditions, as amended from time to time. These General Terms and Conditions are applicable to all Users of the Platform. If you do not agree with these General Terms and Conditions, you must stop using or accessing the Platform immediately. If you are using the Platform or accessing the Platform Services on behalf of a third-party including, but not limited to, a business entity, you warrant that you are authorized and have the authority to bind that third party to these General Terms and Conditions.


1. Definitions

The following terms are used throughout these General Terms and Conditions and have specific meanings.

a) “Account” means the account that the Users are required to register through the Platform to use certain Platform Services;

b) “Agent” means any person who offers Real Estate Services to Users on behalf of a Real Estate Agency in relation to a Property;

c) “Agent Profile” means any Agent related profile made available through the Platform. An Agent Profile may include the name, email address, phone number, photos, videos, personal summary, years of experience, any content publicly available on the internet or social media accounts of Agent and any other information that Sakani may decide to post from time to time;

d) “Agreement” and “General Terms and Conditions” collectively mean all of the terms, conditions and notices contained or referenced in this document (as amended from time to time) and all other Sakani rules, policies available on the Platform (including but not limited to the Privacy Policy, guidelines and procedures that may be published from time to time on the Platform);

e) “Business Day” means a day on which banks in the UAE are open for business (excluding Saturdays, Sundays and public holidays);

f) “Content” means any content submitted, generated, featured, displayed through the Platform, including but not limited to, any Property Profile, Agent Profile, any text, correspondence, photographs, graphics, software, applications, video recordings, audio recordings, sounds, designs, features, and other materials that are available on the Platform. Content includes, without limitation, User Content and Content created by Sakani;

g) “Property” means any real estate property that is listed on the Platform for sale and/or rent;

h) “Property Profile” means any Property related profile made available on (or through) the Platform. A Property Profile may include any content and materials in connection with a Property, including without limitation, all content, photos, images, videos, 3D virtual tours, audios, and visuals, the list price for sale or rent, location, area size, number of rooms and bathrooms, amenities, the relevant land department permit number and any other information that may be posted on the Platform from time to time;

i)“Platform” means any online tool provided, processed and/or maintained by Sakani (including, but not limited to, all subpages and subdomains, all content, Platform Services and products available at or through Sakani’s website located at www.sakanihomes.com and/or its mobile application, and/or any other related domain offering access to, or facilitating the provision of, the Platform Services);

j) “Platform Services” means the online and/or offline services provided by Sakani to Users, including the services set out under clause 2.2;

k) “Privacy Policy” means Sakani’s privacy practices in relation to the use of the Platform, which is available at www.sakanihomes.com/privacy-policy;

l) “Real Estate Agency” means any real estate brokerage firm that has partnered with Sakani to facilitate the sale and/or rent of the Properties by listing them on the Platform. References in these General Terms and Conditions to a “Real Estate Agency” shall be construed to also be a reference to and include each “Agent” of such Real Estate Agency;

m) “Real Estate Services” means any services offered by a Real Estate Agency to Users for the sale and/or rent of the Properties;

n) “Real Estate Services Agreement” means any terms and conditions that govern the provision of the Real Estate Services;

o) “Sakani”, “we” and “us” collectively mean Sakani Technology Solutions FZ-LLC;

p) “Third-Party Content” means any content that belongs to or originates from parties other than Sakani, a User, a Real Estate Agency or Agent;

q) “User”, “you” and “your” collectively mean the person, company, or organization that has visited and/or is browsing and/or using the Platform and/or the Platform Services in any capacity. A User may be, without limitation, a seller, buyer, tenant or landlord of a Property, all or none of them; and

r) “User Content” means any content, written or otherwise, created, submitted, generated, featured, displayed through the Platform (including but not limited to, any User review, chatroom correspondence, text, or any other correspondence, photographs and videos) by the Users while using the Platform.

2. About Sakani and the Platform Services

2.1 Sakani is an online property discovery platform that utilizes proprietary technology to enhance its Users’ experience and that facilitates collaboration between Users and Agents.

2.2 By using the Platform, Users, among other things, may be able to:

a) Browse and compare communities;

b) Interact with the community heatmap;

c) Browse, compare and filter Properties based on User’s preferences;

d) View Property Profiles and save Properties to their favorites list; and

e) Contact Agents through the available communication tools.

3. Changes to the Terms and Conditions

3.1 You agree that Sakani may amend these General Terms and Conditions from time to time, and in Sakani’s sole discretion. Although Sakani will use its best endeavors to notify you of any amendment to these General Terms and Conditions, Sakani will not be required to provide you with prior notification of such amendments or changes to these General Terms and Conditions.

3.2 Upon any amendment or change to these General Terms and Conditions, Sakani will publish the amended General Terms and Conditions on a dedicated link available at the Platform. Your continued use of the Platform and/or the Platform Services after the publication date of a revised version of these General Terms and Conditions constitutes your acceptance of the amended terms.

3.3 You agree and undertake to review our General Terms and Conditions each time you visit our Platform and/or prior to each use of the Platform Services. If you do not agree to our General Terms and Conditions, as updated from time to time, you undertake to cease using our Platform and/or Platform Services immediately.

4. Eligibility and Account Registration

4.1 The Platform Services are not intended for Users that are under the age of 18. Any registration by, use of, or access to, the Platform Services by any person under 18 is unauthorized, unlicensed and in violation of these General Terms and Conditions. By using the Platform Services, you represent and warrant that you are at least 18 years old and are capable of entering into, performing and adhering to these General Terms and Conditions.

4.2 In order to use certain Platform Services, Users will be required to create a personalized Account. Each Account should have a unique username and a password.

4.3 To create an Account, each User is required to provide certain information, including without limitation, their first and last name, email address, contact number and any other details as Sakani may require from time to time.

4.4 Each User is responsible for maintaining the security of their Account, for all activities that occur under the Account and any other actions taken in connection with the Account. You undertake to provide accurate and complete information and keep your Account information and your Account updated. You may not share your password with unaffiliated third parties. You agree to notify Sakani immediately of any unauthorized use of the Account, or any other breaches of security. You are fully responsible for all uses of your Account, password, and username, or registration, whether by you or others. Sakani is authorized to act on instructions received through use of your Account or registration, and is not liable for any loss or damage arising from your failure to comply with this clause 4.

4.5 Your Account, including any information pertaining to it (e.g., contact information, Account history, etc.), is strictly personal to you. You may therefore not sell or charge others for the right to use your Account, or otherwise transfer your Account.

4.6 You may not impersonate someone else, create or use an Account for anyone other than yourself, provide an email address other than your own, create multiple Accounts except as otherwise authorized by us, or provide or use false information to obtain access to an Account that you are not legally entitled to claim.

4.7 We reserve the right to suspend or terminate your Account at any time, with or without cause, with or without notice and effective immediately, including if any User Content or information provided during the registration process or thereafter proves to be inaccurate, false or misleading or to reclaim any username that you create through the Platform that violates these General Terms and Conditions.

5. User Conduct Rules and Restrictions

5.1 Any User that is a seller or landlord of a Property shall not be permitted to list such Property on the Platform in their personal capacity. 

5.2 All Users undertake to treat each other and the Agents respectfully and use their best endeavors to ensure that any interaction with other Users and Agents is conducted in a professional manner.

5.3 Users agree that they will not, under any circumstances, transmit any Content that (i) is unlawful or promotes unlawful activity; (ii) defames, harasses, abuses, threatens, or incites violence towards any individual or group; (iii) is political, anti-national, anti-governmental, pornographic, discriminatory, or otherwise victimizes or intimidates an individual or group on the basis of religion, gender, sexual orientation, race, ethnicity, age, or disability; (iv) is spam, constitutes unauthorized or unsolicited advertising, any other form of unauthorized solicitation; (v) contains or installs any viruses, worms, malware, Trojan horses, or other content that is designed or intended to disrupt, damage, or limit the functioning of the Platform or any software, hardware, or telecommunications equipment or to damage or obtain unauthorized access to any data or other information of Sakani and/or any third party; (vi) infringes on any proprietary right of Sakani and/or any third party, including patent, trademark, trade secret, copyright, right of publicity, or other rights; (vii) impersonates any person or entity, including any of Sakani’s employees or representatives; or (viii) violates the privacy of Sakani and/or any third party.

5.4 Users shall not (i) except to the extent expressly permitted under the Agreement, attempt to copy, modify, duplicate, create derivative works from, frame, mirror, republish, download, display, transmit, or distribute all or any part of the Platform in any form or media or by any means; (ii) attempt to reverse compile, disassemble, reverse engineer or otherwise reduce to human-perceptible form all or any part of the Platform; (iii) access all or any part of the Platform  in order to build a product or service which competes with any of the Platform; (iv) license, sell, rent, lease, transfer, assign, distribute, display, disclose, or otherwise commercially exploit, or otherwise make the Platform available to any third-party; (v) use any meta tags, “hidden text”, robots, spiders, crawlers, or other tools, whether manual or automated, to collect, scrape, index, mine, republish, redistribute, transmit, sell, license or download any Content; or (vi) attempt to obtain, or assist third-parties in obtaining, access to the Platform, other than as expressly provided for in the Agreement.

5.5 By accessing and/or using the Platform and/or the Platform Services, Users represent and warrant that: (i) they have the authority to validly enter into and/or be bound by this Agreement; (ii) their use of the Platform Services will be solely for lawful purposes that are permitted by this Agreement; and (iii) their use of the Platform Services will comply with all applicable laws, rules, and regulations, including anti-corruption and anti-bribery laws, and with all of Sakani’s policies; as amended from time to time.

5.6 If you are using the Platform Services from a jurisdiction other than the United Arab Emirates, you should verify whether your use of the Platform Services is permitted pursuant to the local laws of your jurisdiction. Sakani makes no representations that the Platform Services will be available for use in other locations – if you access any part of the Platform Services from a jurisdiction other than the United Arab Emirates, you do so at your own risk.

5.7 Sakani has the right to, in its sole discretion, determine whether or not any User conduct is appropriate and complies with these General Terms and Conditions. You agree that Sakani has the right to terminate or deny access to your use of any Platform Services for any reason, with or without prior notice.

5.8 Sakani may impose such additional restrictions on the use of the Platform Services by Users as it deems fit in its sole discretion and may, temporarily and with or without notice, restrict the availability of the Platform or certain features thereof to conduct maintenance measures that ensure the proper or improved functioning of the Platform.

6. Real Estate Services and Interactions with Agents

6.1 Real Estate Agencies may offer Real Estate Services outside the Platform, including but not limited to, scheduling Property viewings with Users, assisting with negotiations, coordinating the real estate transaction process with the authorities (such as Real Estate Regulatory Agencies and Land Departments) and visiting such authorities if and when needed, assisting Users with the preparation and submission of any document that may be required to finalize the real estate transaction and collecting funds from Users in relation to the real estate transaction. Users understand and acknowledge that Sakani does not provide, manage or control any Real Estate Services and the delivery and quality of Real Estate Services are the sole responsibility of the respective Real Estate Agency.

6.2 Sakani acts only as a facilitator between the Users and Real Estate Agencies and does not act as an agent of any of the parties. Therefore, Sakani does not make any warranty, guarantee, or representation as to the conduct, performance, quality, qualification, legality or suitability of any Real Estate Agency, Agent or Real Estate Services.

6.3 Users may be required to execute a Real Estate Services Agreement (which is a contractual relationship between the User and the relevant Real Estate Agency) in order to benefit from any Real Estate Services. Each User acknowledges and agrees that Sakani is not and cannot be a party to, or privy to, or control in any manner, any transactions or interactions between Users and Real Estate Agencies concerning the Real Estate Services and shall not be responsible for performing any obligations under any such Real Estate Services Agreement. Each User has complete discretion with regard to the terms of any Real Estate Services Agreement. For the avoidance of doubt, in the event of a conflict between these General Terms and Conditions and a Real Estate Services Agreement as between a Real Estate Agency and a User, these General Terms and Conditions will prevail.

6.4 Users shall be given the option to interact with Agents outside the Platform through telephone calls, email or instant messaging apps or within the Platform through a chat feature on the Platform. Where an inquiry for a Property is submitted on the Platform, the User agrees that their contact details will be forwarded to the concerned Agent. Sakani is not responsible for the acts of Users or Agents during any such interaction. Where a telephone call is initiated by the User, Sakani may provide call-masking services for Users in its sole discretion.

6.5 For the avoidance of doubt, telephone calls and chats with Agents through the Platform may be recorded or monitored by Sakani for quality assurance and training purposes. By using the Platform Services, the User expressly agrees to such recording or monitoring without the need for additional consent.

7. Fees

7.1 Sakani provides Users with its Platform Services free of charge. Sakani may however charge a fee to the Real Estate Agencies for the provision of the Platform Services to the Real Estate Agencies depending on its agreement with the relevant Real Estate Agency.

7.2 In consideration of the provision of the Real Estate Services, Real Estate Agencies may charge service fees or other such fees to the Users. Such fees may or may not be refundable and the Users agree that Sakani shall not be responsible for any refund of or any dispute in connection with such fees paid by a User to a Real Estate Agency.

8. Content

8.1 In consideration of the User’s compliance with these General Terms and Conditions, Sakani grants the User a limited, non-exclusive, non-transferable license to access and view Content on the Platform and avail the Platform Services.

8.2 Sakani is not responsible for any display or misuse of your User Content. You are solely responsible for the content of, and any harm resulting from, any User Content that you submit, post, upload, link to or otherwise make available on the Platform while using the Platform Services. You acknowledge that any liability, loss or damage that occurs as a result of any such User Content is solely your responsibility. You further undertake and agree to indemnify and hold us (and any third-party) harmless from any liability, loss or damage that may occur as a result of any such User Content.

8.3 From time to time, Sakani may allow Users to submit reviews and ratings of Properties, Real Estate Agencies and Agents on the Platform. These reviews do not constitute a guarantee, warranty, or prediction regarding the Platform and Platform Services, any Properties, any Real Estate Agencies and Real Estate Services or any other services or the outcome of any future services offered by Real Estate Agencies or Sakani. Sakani shall be under no obligation to display such reviews and may remove such reviews or publish extracts of such ratings at any time at its sole discretion. Sakani will have no responsibility or liability of any kind for any review you encounter on or through the Platform, and any use of or reliance on such reviews is solely at your own risk.

8.4 All Content posted on the Platform, such as blog posts or reviews, is provided for information purposes only, with no assurance that such Content is true, correct, or accurate.

8.5 Users understand that the Platform Services may contain message boards, chat rooms, profiles, and other interactive features that allow Users to post, submit, publish, display and/or transmit User Content to, and otherwise interact with, Sakani and/or other Users.  Any User Content that a User posts on a page which is publicly available on the Platform will be considered non-confidential and non-proprietary.

8.6 Users represent and warrant that they have the right to post all User Content they submit. Specifically, Users warrant that they have fully complied with any third-party licenses relating to User Content (if applicable), and have made all disclosures to, and obtained all permissions and/or approvals from, each applicable data source as may be necessary or required to display, post or transmit such User Content through the Platform.

8.7 Users agree and acknowledge that Sakani has the right to, in its sole discretion, access, view and monitor any User Content, and to determine whether or not any User Content is appropriate and complies with these General Terms and Conditions, or refuse or remove any User Content that, in Sakani’s reasonable opinion, violates any Sakani policy or is in any way harmful, inappropriate, or objectionable. You further agree that Sakani has the right to make formatting, edits and other changes to the User Content or the manner any User Content is displayed on the Platform.

8.8 Except for Content that originates from Sakani, Sakani does not claim ownership of any Content that you post, upload or link to the Platform. You retain all ownership of, control of, and responsibility for the User Content you post. By posting any Content including without limitation photos, videos, recordings, company logos and reviews via the Platform, you however expressly grant Sakani a worldwide, sub-licensable, fully-paid and royalty-free, and non-exclusive license to use, publish, reproduce, display, modify, adapt, and distribute such Content in connection with Sakani’s business and marketing purposes.

9. Intellectual Property

9.1 Sakani retains ownership of all intellectual property rights of any kind related to Sakani’s Content, the Platform and the Platform Services, including applicable copyrights, patents, trademarks and other proprietary rights. Other trademarks, service marks, graphics and logos used in connection with the Platform and the Platform Services may be the trademarks of other third parties. These General Terms and Conditions do not transfer from us to you any Sakani or third-party intellectual property, and all right, title, and interest in and to such intellectual property will remain (as between the parties) solely with us. Sakani reserves all rights that are not expressly granted to you under these General Terms and Conditions.

9.2 Specifically, Sakani, www.sakanihomes.com, and all trademarks that appear, are displayed, or are used on the Platform from time to time or as part of the Platform Services (except those of Real Estate Agencies) are trademarks of Sakani and may not be copied, downloaded, reproduced, used, modified, or distributed in any way without prior written permission from Sakani.

9.3 If you believe that any material located on or linked to the Platform violates your copyright or other intellectual property rights, please notify us at contact@sakanihomes.com. Without prejudice to any rights available to us as per any applicable law, we will endeavour to terminate a User’s access to (and use of) the Platform if, under appropriate circumstances, a User is determined to be a repeat infringer of the copyrights or other intellectual property rights of Sakani or others.

10. Third-Party Content

10.1 As part of the Platform Services, Sakani may provide you with convenient links to third-party platform(s) as well as other forms of Third-Party Content. These links are provided as a courtesy to you and Sakani has no control over third-party platforms or the content or the promotions, materials, information, goods or services available on them. Sakani is not responsible for any Third-Party Content accessed through our Platform, or products or services offered at such third-party platforms accessed through our Platform. If you decide to leave the Platform and access Third-Party Content, you do so at your own risk and you should be aware that our General Terms and Conditions and other policies no longer govern.

10.2 For avoidance of doubt, these General Terms and Conditions do not authorize you to distribute, publicly display, publicly perform, make available, alter, or otherwise use any Third-Party Content.

11. Email Communications

11.1 We use email and electronic means to stay in touch with our Users. You agree and understand that Sakani may send you emails about present and future Platform Services. Users may opt out of non-essential communications, as determined by Sakani, by managing their account or contacting Sakani requesting removal from non-essential mailing lists.

11.2 For contractual purposes, Users (i) consent to receive communications from Sakani in an electronic form via the email address they have submitted or via the Platform; and (ii) agree that all General Terms and Conditions, agreements, notices, disclosures, and other communications that Sakani provides to them electronically satisfy any legal requirement that such communications would satisfy if it were in a physical writing or traditional mailing; and (iii) without prejudice to clauses 11.2(i) and 11.2(ii), the Users undertake to comply with clause 15.5 for any notification purposes.

12. Disclaimer of Warranties

12.1 The Platform and Platform Services are provided on an “AS IS” basis. Sakani makes no representation or warranty that Content we provide through the Platform or that is provided through the Platform Services by a User is accurate, reliable or correct; that the Platform Services will meet your requirements; that the Platform or Platform Services will be available at any particular time; that the Platform or Platform Services will function in an uninterrupted manner or be secure; that any defects or errors will be corrected; or that the Platform or Platform Services are free of viruses or other harmful components.

12.2 Sakani hosts Property Profiles and Agent Profiles in good faith based on details and information received from Real Estate Agencies and Agents. While Sakani uses commercially reasonable efforts to confirm the details provided by Real Estate Agencies, Sakani makes no representations, warranties or guarantees, whether express or implied about Property Profiles or Agent Profiles. Users should conduct their own due diligence in relation to each Property Profile or Agent Profile made available to them through the Platform. Users are solely responsible for all of their communications and interactions with Agents and with whom they communicate or interact as a result of their use of the Platform Services and/or Real Estate Services. Users understand that Sakani is not required to screen or inquire into the background of any Agent, nor does Sakani make any attempt to verify the statements of Agents or the Content provided by Agents. Users agree to take reasonable precautions in all communications and interactions Agents and with other persons with whom Users communicate or interact as a result of your use of the Platform Services and/or Real Estate Services.

12.3 All Content available on the Platform is for general information only and is not and should not be regarded as legal, financial, investment or real estate advice. Sakani does not endorse any of the opportunities that appear on the Platform nor make any recommendations regarding the same to any User. Any information made available on the Platform does not represent a solicitation of an offer to buy, rent or sell any Property. Users should make their own inquiries and obtain independent professional advice before making any legal, financial, investment or real estate decisions.

13. Release and Indemnification​​​​​​​

13.1 Users agree to indemnify and hold harmless Sakani from and against any and all claims, demands, actions, losses, damages, assessments, charges, third party liabilities, costs and expenses which may arise as a result of (i) the Users’ use of the Platform and the Platform Services or violation of this Agreement; (ii) any injury, accident, health issues, physical or property damage, loss of profit, property or business reputation, or otherwise that may be caused by a User as a result of the User’s use of any Platform Services and/or Real Estate Services; (iii) errors, mistakes, or inaccuracies of User Content, and/or information available on or through the Platform; (iv) any bugs, viruses, trojan horses, or the like, which may be transmitted by a User to or through the Platform; or (v) any dispute, conflict or disagreement between a User and a Real Estate Agency and/or Agent or a third-party in connection with any Platform Services or Real Estate Services.​​​​​​​

13.2 If you have a dispute with another User, Real Estate Agency or Agent or any third-party as a result of your use of the Platform Services, you release Sakani from any and all claims, demands and damages (actual and consequential) or losses of every kind and nature, arising out of such disputes. Sakani shall neither be responsible nor liable to mediate or resolve any such disputes. ​​​​​​​

13.3 Users agree that in no event will Sakani be liable, responsible or otherwise, to Users or to third parties for any damages or losses that may arise from (i) the failure, interruption or disruption of any service or failure to maintain a User’s access to the Platform or the Platform Services, regardless of whether the service is provided by Sakani or a third party; (ii) the quality, accuracy, timeliness, reliability, safety, performance of a Real Estate Agency, an Agent, the Real Estate Services, or completeness or delays, breach, omissions, or interruptions in the delivery of any Real Estate Services; (iii) errors, mistakes, or inaccuracies of any Content (including Property Profile or Agent Profile), Third-Party Content and/or information available on or through the Platform; (iv) any unauthorized access to or use of our servers and/or any and all personal information stored therein, and/or any interruption or cessation of transmission to or from our servers, and/or any bugs, viruses, trojan horses, or the like, which may be transmitted to or through the Platform by any third-party; (v) any failure or delay in the execution of any transactions through the Platform and/or the Platform Services; (vi) any dispute, conflict or disagreement between you and a Real Estate Agency and/or Agent or any third parties in connection with any Platform Services or Real Estate Services; or (vii) any refund, loss of profits, loss of business reputation (whether incurred directly or indirectly), any injury or accident or physical or property damage or otherwise that may occur to a User as a result of User’s use of any Platform Services or Real Estate Services.

14. Termination

14.1 If you wish to close your Account or terminate this Agreement, you may simply discontinue accessing the Platform and using the Platform Services. If you wish to delete your Account data, please contact Sakani at contact@sakanihomes.com. Sakani will retain and use your information as necessary to comply with its legal obligations, resolve disputes, and enforce Sakani’s agreements, and Sakani will, following request, delete your full profile to the extent possible (if applicable).​​​​​​​

14.2 You may request to close your Account at any time by contacting us at contact@sakanihomes.com. Your request may take up to 30 Business Days to process. You will remain liable for all obligations related to your Account even after your Account is closed, suspended or restricted. Termination of this Agreement will not affect any rights, remedies, obligations or liabilities of the parties hereto that have accrued up to the date of termination.​​​​​​​

14.3 All provisions of these General Terms and Conditions which by their nature should survive termination will survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.​​​​​​​

15. Miscellaneous​​​​​​​

15.1 Governing Law: This Agreement between you and Sakani and any access to or use of the Platform and/or the Platform Services are governed by the laws of the United Arab Emirates. Any dispute which may arise between a User and Sakani pertaining to the implementation or interpretation of this Agreement shall be amicably settled, failing which Courts of Dubai shall be the competent authority to settle the same.​​​​​​​

15.2 Severability: If any part of this Agreement is held invalid or unenforceable, that part of the Agreement will be construed to reflect the parties’ original intent. The remaining portions will remain in full force and effect. Any failure on the part of Sakani to enforce any provision of this Agreement will not be considered a waiver of Sakani’s right to enforce such provision. Sakani’s rights under this Agreement will survive any termination of this Agreement.​​​​​​​

15.3 Assignability: Sakani may assign or delegate its rights or obligations under these General Terms and Conditions and/or Privacy Policy, in whole or in part, to any person or entity at any time with or without your consent. You may not assign or delegate any of your rights or obligations under these General Terms and Conditions or Privacy Policy without Sakani’s prior written consent, and any unauthorized assignment and delegation by you shall be considered as null and void.​​​​​​​

15.4 Notices to Users: Reports, statements, notices and any other communications may be transmitted by Sakani to Users via the email address specified by them in their Account. All communications and notices shall be deemed to be duly served to a User when electronically sent by Sakani to User to the email address specified in the User’s Account.​​​​​​​

15.5 Notices to Sakani: Reports, statements, notices and any other communications may be transmitted by a User to Sakani at contact@sakanihomes.com. All communications and notices shall be deemed to be received or served (as applicable) to Sakani when electronically received by the Sakani at contact@sakanihomes.com. ​​​​​​​

15.6 Gender Neutral: Wherever used herein and required by the context, the singular number shall include the plural, the plural shall include the singular number, and the use of either gender shall include both genders and the words “hereof” and “herein” and “hereafter” shall refer to the entire Agreement and not to any provision or section.​​​​​​​
